Come learn about one of the most powerful and impactful tools in the real estate litigator’s bag: the Lis Pendens a.k.a. the Notice of Pendency of Action. This program will explore in detail the purpose and function of a lis pendens, the statutory and technical requirements for a lis pendens, proper and improper use of a lis pendens, strategic considerations as to the lis pendens in litigation and real estate transactions, and recent important developments in lis pendens case law. Our speakers each have more than 20 years’ experience litigating real estate cases through trial and on appeal, and regularly deal with lis pendens use, abuse, and expungement in their practices. Two of our speakers are the attorneys of record in an important recent published opinion in the lis pendens universe, Shoker v. Superior Court of Alameda County.
